Terms of Service

These are the terms on which Luuqo is offered. They describe what the software does today, not what it is planned to do.

Draft, not yet in effect. This document has been prepared for review and has not been adopted. It is not linked from anywhere on this site and does not bind anyone until it is.

1. What Luuqo is

Luuqo is business software delivered over the internet. You open an account for your business, then install the modules you want from the Store inside that account โ€” a sales counter, a stall sales book, an item catalogue, stock records, a booking page. Each module is a separate product with its own plans and prices, bought and cancelled on its own.

One account holds your whole business, including every outlet you open. You invite the people who work for you as users of that account and give each of them a role; a role decides which pages of which modules that person can open.

Some modules can serve a page to your own customers at a public address under your business code โ€” a booking page is the one that does so today. That page is served by Luuqo, and what appears on it is what you put there.

2. Your account, and who is responsible for it

The account owner is responsible for everything done through the account. In practice that means:

  • Anything done under a sign-in is treated as done by the person that sign-in belongs to. Keep your business code, username and password to yourself, and give each member of staff their own sign-in rather than sharing one.
  • You are responsible for the staff accounts you create and the roles you give them, including anything those people do or delete.
  • The details you register โ€” your business name, your email address, and your business registration number if you enter one โ€” must be accurate, and you must keep them up to date. Your email address is the only way we can reach you.
  • You agree not to attempt to reach another business's data, to probe or interfere with the service, or to use it for anything unlawful.

We may suspend an account that is used against this clause. Where we can give notice first, we will.

3. Your business records are yours to get right

Luuqo records what you tell it. It does not check your figures, and in several places it deliberately leaves the arithmetic to you. You remain responsible for the accuracy of everything your business produces through it โ€” prices, costs, stock counts, receipts and any tax you charge.

Two specifics, stated plainly because they are the ones most likely to matter:

  • Stock figures are only as good as the counts you enter. The counter deducts what a sale says it sold, from the opening balances and movements you recorded. Nothing counts your shelves for you.
  • QR payments are not verified by Luuqo. The counter shows your own QR code, but it cannot confirm that the money reached your account โ€” you check that yourself.

4. What you need in order to use it

Luuqo runs in a web browser, and most of it needs an internet connection to work.

  • A working internet connection, including at the counter. Two limited exceptions: the POS System counter in the Luuqo Android app can keep recording cash sales while the connection is down and send them when it returns; and Buku Jualan Gerai keeps sales on the phone as long as its sales page is already open. In a plain browser the POS System counter cannot record a sale without a connection. A sale not yet sent exists only on that device until it is sent.
  • A reasonably current browser. Receipts print through the browser's own print dialog, so that window has to be allowed to open.
  • Your own hardware. The counter is built for touch and runs on a tablet or a computer you already own; we do not supply, configure or maintain any device, printer or screen.

5. Paying for a module

Most modules are billed monthly, and some also offer a yearly plan. You are billed at the price and plan shown in your account when you subscribe. Prices are shown to you before you commit, and they are the only prices that apply โ€” nothing on this website quotes one.

  • You are charged per module. If you take three modules you have three subscriptions, each renewing on its own date, and you will receive a separate bill for each rather than one combined invoice.
  • Payment is taken by an independent payment provider. You are sent to their page to pay, by online banking or card, and those details are entered there. Card and banking credentials never reach Luuqo and we never store them. To raise a bill we pass that provider your business name, your contact email address and the amount.
  • If your account is priced in US dollars, the amount actually charged is that price converted to Malaysian ringgit at the rate applied when the bill is raised. The ringgit figure can therefore differ from one month to the next.
  • Where a discount code applies to your account, the amount charged is the discounted amount.
  • Your first outlet comes with your plan. Each additional outlet has its own monthly charge, shown in the app.

6. If a payment is not made

This happens per module, and it does not touch the rest of your account.

  • When a subscription reaches the end of its period, a renewal bill is raised and the payment link is emailed to your contact address.
  • While that bill is outstanding you keep using the module. There is a short grace period, and it is deliberately not quoted here as a number of days because it is not fixed policy โ€” treat the emailed bill as due when you receive it.
  • If the bill is still unpaid at the end of that period, that module is cancelled and drops out of your account, with a notice in the app telling you why. You can re-subscribe from the Store at any time.
  • Your other modules keep working, your sign-in still works, and nothing on this path deletes your business records.

7. Trials, where a module offers one

Some modules may be offered on a free trial. This is decided per module and is not a feature of every one, so whether a trial is available is what your account shows you at the time.

  • No card is taken for a trial and a trial never turns itself into a paid subscription.
  • A trial can be taken once per module per business. Uninstalling and reinstalling does not reset it.
  • When a trial ends, access to that module stops until you subscribe. Your other modules are unaffected.
  • If you do not subscribe, records that module created may be deleted a short while after the trial ends, and you are warned in the app before that happens. Subscribing during the window keeps everything.

8. Stopping

  • You can unsubscribe from any module at any time, from the Billing page in your account. The module is removed and your records for it are kept, so reinstalling it later gives you your data back.
  • To close the whole account, write to us. We will confirm before anything is deleted.
  • We may suspend or close an account that breaches these terms or has long-overdue bills. Where we can give notice first, we will.

Take copies of anything you need before you close an account. Most lists in Luuqo have a Download CSV button โ€” but not all of them do: there is no export from the sales counter today, so a business using only the counter cannot download its own records from inside the product. Ask us and we will help.

9. What we do not promise

The service is provided as it is. We would rather name the gaps than let a template imply commitments we have not made. As things stand, Luuqo publishes:

  • no uptime or availability figure, and no maintenance window. The service can be unavailable, and there is no service credit for it.
  • no response time for support, and no support hours.
  • no backup, restore or retention commitment for your business records.
  • no undertaking that any particular feature will be built, or that one described as coming will arrive.

Where any of these becomes a commitment we can keep, it will be written here and dated. Until then, treat its absence as the answer.

10. Our liability

To the fullest extent the law allows, Luuqo is not liable for lost profits, lost sales, loss of goodwill, or any indirect or consequential loss, and is not liable for loss or corruption of data caused by anything outside our control.

Where we are liable, our total liability for all claims in any twelve-month period is limited to the subscription fees you paid us in the three months before the claim arose.

Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or for fraud.

11. Changes

We may change these terms. When we do, the changed version is published here with a new date, and where a change materially affects you we will tell you by email before it applies to your account.

We may also change what a module does. Features are added, and occasionally one is removed or replaced. Where a change removes something you are paying for, you may cancel that module rather than accept it.

12. Law, and how to reach us

These terms are governed by the laws of Malaysia, and the courts of Malaysia have jurisdiction over any dispute arising from them.

Before that, write to us. Most things a customer takes seriously enough to look up these terms for are things we would rather fix.

The name, registration details and registered address of the party these terms bind are to be inserted before this document is adopted. They are deliberately not filled in with a guess.
